Acceptance of these terms

Vaiya Labs is a product of, and operated by, Imbas Tech LLC ("Vaiya," "we," "us"). By accessing or using the Vaiya Labs app or website, you agree to these Terms of Use and to our Disclaimer and Privacy Policy. If you do not agree, do not use our services. Vaiya is a skincare education and routine-tracking tool intended for personal, non-commercial use. Vaiya is intended for adults: you must be at least 18 years old to use it. It is not directed to children, and we do not knowingly collect information from anyone under 18.

Not medical advice; no professional relationship

Vaiya provides general educational information about skincare. Nothing in the app or on this site constitutes medical, dermatological, or other professional advice, diagnosis, or treatment, and no doctor–patient or professional relationship is created by your use of Vaiya. Always seek the advice of a qualified dermatologist or healthcare professional with any questions about a skin condition, allergy, medication, or before starting, stopping, or changing any product or routine. Never disregard or delay seeking professional advice because of something you read or saw in Vaiya.

Product information and accuracy

Product and ingredient data shown in Vaiya is sourced from third-party databases (including Open Beauty Facts and other open, community-maintained sources) and from manufacturers, and may be incomplete, inaccurate, mislabeled, or out of date. Formulas change without notice. Vaiya does not manufacture, sell, test, or endorse any product and does not guarantee the accuracy of any ingredient list, description, claim, or price. The ingredient list printed on the actual product packaging is always the only authoritative source, and you must read it yourself before purchasing or using any product.

Allergens and adverse reactions

Any allergen filtering, "safe for" indications, ingredient flags, or routine suggestions in Vaiya are convenience features based on incomplete third-party data and general information. They are not a guarantee that a product is free of any allergen or safe for you, and you must not rely on Vaiya to determine whether a product is safe for an allergy or sensitivity. If you have any allergy or sensitivity, always read the full ingredient label on the physical product, patch-test before use, and consult your doctor or allergist. You are solely responsible for deciding what to buy, apply, or use. Vaiya is not responsible for any allergic reaction, irritation, breakout, injury, or other adverse effect.

Assumption of risk

Skincare involves inherent risks, including the possibility of irritation, allergic reaction, or other adverse effects, which can occur even with products and ingredients generally considered safe. By using Vaiya and any information, recommendation, or product you learn about through it, you knowingly and voluntarily assume all such risks and accept full responsibility for your choices.

Disclaimer of warranties

Vaiya and all content, data, and recommendations are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any information is complete or current.

Limitation of liability

To the fullest extent permitted by law, Vaiya Labs and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, adverse reaction, loss, or damages of any kind arising out of or related to your use of (or inability to use) Vaiya, any product or ingredient information, or any recommendation, routine, or link — even if advised of the possibility of such damages. Where liability cannot be excluded, our total aggregate liability to you for all claims will not exceed one hundred U.S. dollars (US$100.00) or the amount you paid us, if any, in the twelve months before the claim, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Vaiya Labs and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of Vaiya, your violation of these terms, or your reliance on any information obtained through the service.

Subscriptions, billing, and cancellation

Some Vaiya features ("Sophie+") require a paid subscription. Current prices and billing periods are shown in the app before you purchase. Subscriptions are sold and processed by the store or payment provider you buy through — Apple (via RevenueCat) for in-app purchases on iOS, and Stripe for purchases on the web — and your purchase is also subject to that provider's own terms.

Auto-renewal. Paid subscriptions renew automatically for the same period at the then-current price unless you cancel before the renewal date. Your payment method is charged at the start of each period.

Cancelling. You can cancel at any time — on iOS, in your Apple ID subscription settings; on the web, through the billing link in the app. Cancellation stops the next renewal; you keep access through the end of the period you have already paid for. We do not provide pro-rated refunds for partial periods except where required by law or by the store's own policies.

Refunds. Because purchases are handled by Apple or Stripe, refund requests are subject to their policies and to applicable law. Where a refund is available, it is issued through the same provider you purchased from.

Free trials, promotional, and beta access. We may offer free trials, complimentary access, or beta access from time to time. Any such access is promotional and provided at our discretion — it may be limited in time or scope, changed, or ended, and it does not automatically convert into a paid subscription. When a trial or promotional period ends, paid features simply stop unless you choose to subscribe. Where we describe a specific promotional term (for example, a defined beta period), the terms shown to you at that time apply.

Price changes. We may change subscription prices. Any change applies to future billing periods, and where required we will give you notice and the opportunity to cancel before it takes effect.

Intellectual property

The Vaiya name, logo, app, and original content are the property of Vaiya Labs. You may not copy, reproduce, or distribute our original content without permission.

Governing law

These terms are governed by the laws of the United States and the state in which Vaiya Labs is established, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms from time to time. Continued use of the app or website after changes constitutes acceptance of the updated terms.
